1. Overview
This website and online store are operated by Tarik Toumi Abidi . By browsing the site or placing an order, you agree to these Terms, our Privacy Policy, our Refund Policy  and our Shipping Policy. If you do not agree, please do not use the site.

2. Eligibility
You must be old enough to enter into a binding contract in your country of residence. If you allow a minor to use the site on your device, you are responsible for their use. You agree to give us accurate and complete information when you order, and to keep your account details secure.

3. Products
We try to describe and show our products as accurately as possible. Colors may look slightly different depending on your screen. We may change or discontinue products and limit quantities. This does not affect your rights if a product is defective or does not match its description.

4. Orders and acceptance
Your order is an offer to buy. A contract is formed when we send you an order confirmation email, and we may decline an order before that, for example if an item is out of stock, an address is invalid, or we suspect fraud. If we decline or cancel an order after you have paid, we will refund you in full. If a product is listed at an obvious pricing error, we may cancel the order and refund you. Your right to cancel and return is governed by our Refund Policy.

5. Prices and payment
Prices are shown in the currency displayed at checkout. Where the law requires, prices include applicable taxes such as VAT. Otherwise, taxes and shipping are shown before you pay. Orders shipped internationally may be subject to customs duties, import taxes or fees charged by your country, which are your responsibility unless we state otherwise at checkout. By paying, you confirm that you are authorized to use the payment method.

6. Shipping and delivery
Delivery times are estimates, not guarantees, and are explained in our Shipping Policy. Risk of loss or damage passes to you when the goods are delivered to you or to a person you have designated. If your order is lost or arrives damaged, contact us and we will resolve it in line with our Refund Policy.

7. Returns, refunds and legal guarantee
Returns and refunds are covered by our Refund Policy. Nothing in these Terms limits your statutory rights as a consumer, including any legal guarantee that products must be of satisfactory quality and match their description.

8. Intellectual property
All content on this site (text, images, logos, designs, brand names) belongs to us or our licensors and is protected by intellectual property laws. You may use the site for personal, non-commercial purposes only. You may not copy, reproduce or distribute our content without our written permission.

9. Acceptable use
You agree not to use the site to: break the law; infringe the rights of others; send spam, viruses or malicious code; collect other people's personal data; scrape or extract data from the site by automated means; or interfere with its security or operation. We may suspend or block access if you breach these Terms.

10. Customer reviews and communications
If you send us a review or comment, you confirm that it is yours and that it is truthful, and you allow us to publish and use it in connection with our store, without compensation. We may remove content that is unlawful, offensive or misleading.

11. Third-party links and tools
The site may include links or tools provided by third parties. We do not control them and are not responsible for their content or practices. Please read their own terms before using them.

12. Relationship with Shopify
Evergleam is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Evergleam. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Evergleam, including any injury, damage, or loss resulting from purchased products and services. You hereby release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Evergleam.

13. Privacy
We process your personal data as described in our Privacy Policy [LINK]. Because the site is hosted by Shopify, your data may be processed by Shopify and other service providers in countries other than your own.

14. Disclaimer and limitation of liability
To the maximum extent permitted by law, the site is provided "as is" and "as available", and we are not liable for indirect or consequential losses, such as lost profits or data, arising from your use of the site or products. Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, fraud, or defective products, nor any of your mandatory consumer rights.

15. Changes
We may update these Terms by posting the new version on this page with a new date. Changes apply to orders placed after that date and do not affect orders you have already placed.

16. Governing law and disputes
If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in the courts of your country of residence where the law allows it.
